In a dramatic twist to the ongoing legal battle over the Kawempe North by-election results, Faridah Nambi, the National Resistance Movement (NRM) candidate, has been dealt a major blow in her petition challenging the victory of Elias Luyimbazi Nalukola.
During a tense preliminary hearing at the Kampala High Court on Wednesday morning, it was revealed that several key witnesses, who had initially supported Nambi’s petition, have now shockingly changed their testimonies. These witnesses, who had earlier alleged electoral malpractice, now claim they were coerced into making false statements and were pressured to testify in favor of Nambi’s case.
To make matters even more explosive, it was disclosed that the witnesses secretly approached Nalukola’s legal team, stating their desire to recant their previous testimonies and instead testify against Nambi. The witnesses reportedly accused her legal team of manipulation and intimidation.
Nambi’s defense team, led by Crane Associated Advocates, fiercely opposed the witnesses’ sudden change of heart, claiming it was a result of undue influence from Nalukola’s camp. They urged the court to block their testimonies, arguing that they were being used as pawns in a political game.
However, Nalukola’s legal representatives, spearheaded by Counsel Muhammad Mbabazi, countered that these recanted testimonies were crucial to uncovering the truth about the violence-ridden election. They insisted the witnesses should be allowed to testify, regardless of their sudden reversal.
With tensions mounting, the court adjourned the matter to Monday, when it will decide whether to allow the witnesses’ controversial statements to stand in the ongoing case.
Nambi’s petition accuses Elias Nalukola Luyimbazi of widespread electoral fraud and irregularities during the March 13 by-election, demanding a fresh poll. As the case unfolds, it appears the scandal surrounding the Kawempe North by-election is far from over!
The legal battle surrounding the Kawempe North by-election results has taken a sensational turn, as Faridah Nambi, the NRM candidate, faces a massive setback in her petition contesting Elias Luyimbazi Nalukola’s victory.
In a courtroom spectacle on Wednesday morning, it was revealed that crucial witnesses, who were supposed to back Nambi’s claims of electoral fraud, have now dramatically reversed their testimonies. The witnesses stunned the court when they admitted that they were pressured into testifying in favor of Nambi’s case, with some even alleging they were coerced into providing false evidence.
The plot thickened when it emerged that these same witnesses, seeking to distance themselves from the allegations, secretly approached Nalukola’s legal team. They expressed their desire to withdraw their previous statements and, instead, testify against Nambi, throwing her entire case into jeopardy. According to the witnesses, they were manipulated and intimidated by Nambi’s team to deliver their original testimonies.
Nambi’s legal team, led by Crane Associated Advocates, vehemently opposed the witnesses’ sudden change of heart, accusing Nalukola’s camp of orchestrating a strategic move to sabotage their case. They urged the court to block the witnesses’ new statements, claiming they were being unduly influenced by the opposing side.
However, Nalukola’s defense team, under the guidance of Counsel Muhammad Mbabazi, insisted that the recanted testimonies were vital for uncovering the truth about the violence-riddled election. They argued that the witnesses must be heard, regardless of their sudden flip, as their statements could expose the full extent of the election irregularities.
The drama intensified as the court decided to adjourn the case until Monday, when it will determine whether these retracted testimonies will be allowed to stand in the ongoing petition.
Nambi, who is accusing Elias Nalukola Luyimbazi of masterminding a rigged victory in the March 13 by-election, has demanded a fresh election, citing widespread irregularities. With the stakes higher than ever, the legal showdown in Kawempe North is now set to become a full-blown political drama, with the outcome hanging in the balance!
